The Restore Online Shoppers’ Confidence Act was signed into law on December 29, 2010. And it expressly bars online sellers from transferring a customer’s credit card information to another company that is advertising on their sites (a process known as “data pass”).
It also bars the use of the “negative option”, which had allowed consumers to be billed for goods or services unless they said no. Now only affirmative action or negative options with “express informed consent” is permissible.
So make sure if you sell on line you conform to these new, more restrictive, law requirements by checking your sites and practices or face sever penalties.
